1. Acceptance of these terms

By accessing or using the Service, joining the waitlist, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the service

TrainWatch watches public railfan webcams and alerts you when a train is detected. When activity is detected on a camera you have configured, the Service may capture annotated snapshot images and deliver alerts to you by email or, if you provide a Telegram chat ID, by Telegram.

3. Early access and fees

The Service is currently offered free of charge during early access. We may change, introduce, or discontinue pricing at any time. We will provide notice of material pricing changes before they apply to you.

4. "As is" — no warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any train detection or alert will be accurate, complete, or delivered. Do not rely on the Service for safety-critical decisions.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
• Reverse engineer, scrape, or misuse the Service or attempt to overload our systems.
• Use the Service to infringe the rights of others or to harass, abuse, or harm anyone.

6. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Notify us promptly of any unauthorized use of your account.

7. Third-party data source

The Service relies on public webcam streams provided by Virtual Railfan, a third party. TrainWatch is an independent product and is not affiliated with, endorsed by, or sponsored by Virtual Railfan. We do not control these streams and do not guarantee their availability, accuracy, or continuity. If a source stream changes or becomes unavailable, detection and alerts for that source may stop without notice.

8. Limitation of liability

To the maximum extent permitted by law, PeachByte and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, including any missed, delayed, or inaccurate alerts. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim (which, during free early access, may be zero).

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including if you violate these Terms. You may stop using the Service at any time and may request deletion of your account by emailing [email protected].

10. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
